1. Who we are

Musiekpret ("Musiekpret", "we", "us" or "our") operates www.musiekpret.co.za and presents the Musiekpret musical game show. We are the "responsible party" for the personal information described in this policy, as that term is used in the Protection of Personal Information Act 4 of 2013 ("POPIA").

This policy explains what personal information we collect through the website and when you deal with us about a show, why we collect it, who we share it with, how long we keep it and what your rights are.

2. What we collect

Information you give us:

• through the enquiry form: your name, organisation, email address, phone number, preferred and alternative dates, whether your date is flexible, town or venue, approximate number of guests, type of event, and anything you add about your programme or event;
• when you WhatsApp, phone or email us: your contact details and whatever you tell us;
• if you book: the details needed to arrange and invoice your show, such as venue contacts, programme times and billing details.

Information collected automatically when you visit the website:

• our web server records your IP address, the pages requested, the time, and your browser type, in standard access logs kept for security and troubleshooting;
• Google Analytics records how the website is used (pages viewed, approximate location derived from your IP address, device and browser type, and whether an enquiry was sent, together with the type of event chosen). See section 7 on cookies.

We do not ask for, and do not want, special personal information (such as health, religious or biometric information) or financial account details through the website. Please do not include information about other people, including children, unless you are entitled to share it.

3. Why we use it and on what basis

We use personal information to:

• respond to your enquiry, check availability and prepare a quotation;
• arrange, plan, present and invoice a show you have booked;
• communicate with you about your enquiry or booking;
• keep business and financial records, and comply with the law;
• protect the website and our systems against misuse;
• understand how the website is used, so that we can improve it.

Under POPIA we rely on the following grounds: processing is necessary to take steps at your request before entering into a contract and to perform that contract; it protects a legitimate interest of yours or ours (responding to you, running our business, keeping the website secure); it is required by law (for example, tax records); and, for analytics cookies and any marketing, your consent.

Giving us your information is voluntary. Without the details marked as required on the enquiry form we cannot respond to you or check your date.

4. Marketing

We do not sell your information and we do not send marketing by electronic means unless you have asked for it or you are an existing customer, in which case you can opt out at any time by replying to a message or emailing us. We do not share your details with other businesses for their marketing.

5. Who we share it with

We share personal information only as needed, with:

• service providers who process it on our instructions and under contract: our website developer and hosting provider, our email delivery provider (Resend, Inc.), Google (Google Analytics and Google Fonts) and, if you use the WhatsApp button, WhatsApp (Meta Platforms);
• the people who help us run your show, such as a sound engineer or the venue, where they need to coordinate with you;
• our professional advisers, such as accountants and attorneys, where necessary;
• courts, regulators and law enforcement, where the law requires it or to protect our rights.

6. Transfers outside South Africa

Some of our service providers process information in other countries. Email sent through the enquiry form passes through Resend, Inc. in the United States, and Google processes analytics and font requests on servers that may be outside South Africa. Where information leaves South Africa we rely on the provider being bound by contractual terms that give a level of protection substantially similar to POPIA, or on the transfer being necessary to respond to your request, as section 72 of POPIA allows.

7. Cookies and analytics

The website itself sets no cookies of its own. It uses Google Analytics (Google Ireland Limited and Google LLC), which sets cookies named _ga and _ga_* to tell returning browsers apart and to measure how the website is used. These cookies last up to two years. Google Analytics is set to anonymise where it can and we do not use it to identify you by name.

You can refuse or delete cookies in your browser settings, or install the Google Analytics opt-out browser add-on. The website works without cookies. Loading the fonts used on the website also sends your IP address to Google Fonts.

8. How long we keep it

• Enquiries that do not lead to a booking: up to three years after our last contact, so that we can respond if you come back to us, after which they are deleted.
• Bookings and related correspondence: for the life of the booking and then for five years, which the Tax Administration Act requires for financial records.
• Web server logs: 14 days.
• Google Analytics data: according to the retention period set in our Google Analytics account, which is no longer than 14 months, and in aggregated form after that.

9. How we protect it

The website is served over HTTPS, enquiry emails go only to the Musiekpret mailboxes that need them, and access to those mailboxes and to our systems is limited to the people who need it. We use reputable providers and keep our software up to date. No method of transmission or storage is completely secure, but if we become aware that personal information has been accessed or acquired by an unauthorised person, we will notify the Information Regulator and the people affected, as POPIA requires.

10. Photographs and video at shows

We sometimes take photographs or video at shows to use on our website and social media. We tell the organiser beforehand. If you would prefer not to be photographed, tell the host on the night, and if you find a picture of yourself on our website that you would like removed, email us and we will take it down.

11. Your rights

Under POPIA you may:

• ask whether we hold personal information about you, and ask for a copy of it (a reasonable fee may apply, and we will confirm your identity first);
• ask us to correct or delete information that is inaccurate, out of date, incomplete, misleading or no longer needed;
• object to processing that relies on a legitimate interest, and object to any direct marketing at any time;
• withdraw consent where processing relies on it;
• complain to the Information Regulator if you believe we have handled your information unlawfully.

12. Children

The website is intended for adults arranging events. We do not knowingly collect personal information from children under 18 through the website. If you believe a child has sent us information, email us and we will delete it.

13. Other websites

The website links to WhatsApp and to Google services. Those services have their own privacy policies, which apply when you use them.

14. Changes to this policy

We may update this policy from time to time. The date at the top of the page shows when it was last changed. Significant changes will be flagged on the website.
